Public Sector Regeneration & Development

The Public Sector law team has extensive experience and an excellent track record of delivering complex, long term, sensitive and challenging projects involving the public sector and public sector/private sector in regeneration and development projects. Many of the team are recognised by the legal press and their peers as experts in regeneration and regularly contribute to articles and provide training on aspects of regeneration in addition to their transactional work.

Key work types include:

  • Structuring regeneration transactions including consideration of the Public Contract Regulations 2015 and alternatives such as Flensburg and development through bodies not governed by public law
  • Development agreements and development management agreements
  • Collaboration agreements
  • Joint venture agreements
  • Land assembly and disposals
  • Title due diligence
  • Establishing and implementing vacant possession strategy to enable development
  • Overage and profit share arrangements
  • Strategies for best value and maximising income generation
  • Funding and forward funding arrangements
  • Construction documentation including building contract, forms of appointment and warranty package
  • Planning and CPO.

The Public Sector team is currently advising on regeneration projects including the regeneration of a significant part of Derby City Centre, the development of Park Hill (the largest listed building in Europe), the development of a new Retail Park of the M6 in Carlisle as well as the comprehensive regeneration of the former Ministry of Defence Airfield at St Athan; and the development of a series of wind farms in South Wales.

We also have experience of advising on significant road, highway and infrastructure projects which requires us to address complex legal issues and to liaise with multiple parties involved in or affected by these projects. These include advising the Welsh Ministers in relation to the controversial M4 Corridor around Newport, the Ashbourne Link Road in Derbyshire; Hollis Lane HS2 Link Road in Chesterfield; Congleton Link Road Scheme and Poynton Relief Road in Cheshire; the redevelopment of Halifax railway station and land around it; and the major upgrading of the Dee road bridge in Deeside to improve access between North Wales and England.

The team is also undertaking ground-breaking work in energy enabling a local authority to cut carbon and supply clean electricity, generate power for itself and to sell to generate millions of pounds to support and provide council services.
