The Geldards Commercial Property and Property Dispute Resolution Teams would like to invite you to an upcoming Seminar on Tuesday 23rd October 2018 in partnership with RICS.

The new Electronic Communications Code was brought into force on 28 December 2017. It aims to strike a balance between the competing interests of landowners/occupiers and the telecoms industry and its customers, who want greater access to electronic communication services. For landowners, dealing with a Code that has previously been interpreted as pro-Operator, we will look at the extent to which the new Code brings a change in policy.

We will also take a look at the most significant changes under the new Code. These include issues such as operators rights to freely assign, upgrade and share apparatus where certain conditions are satisfied; what ‘Land’ is caught by the Code ; valuation issues including compensation for adjoining owners; and the Court’s powers to impose agreements where parties are unable to agree.

Falcon Chambers in London are the outstanding property chambers in the UK. We are delighted that two of their leading barristers, Stephanie Tozer and Wayne Clark,  who are experts in this area, being part of a team from Falcon Chambers who have written a detailed text book on the subject, and having appeared in several key cases, have agreed to speak at this seminar.

We will provide more information at the seminar about tailored workshops which we will be offering. These will be bespoke and intended to guide landowners, occupiers and their surveyors through the process so that they are equipped to ensure that they can negotiate the best outcomes from these changes.
