Government commits to an implementation date for no fault divorce

In response to a Parliamentary question, Ministers have finally announced a commencement date for the long awaited no fault divorce system which will allow couples to divorce without being forced either to establish blame or a period of separation in order to end their marriages.

The Divorce, Dissolution and Separation Act 2020 will come into force on 6 April next year. This delayed date is to allow time to implement the necessary adjustments to the courts’ online divorce process which has been marred with difficulty since it was launched.

Geldards’ Head of Family, Fiona Apthorpe said:

“This is welcome news for many of our clients. The implementation of the new system has been delayed over the past few years due to Brexit and Covid and although the legislation will not now come into force until next year at least we now have some measure of certainty. Most divorcing couples neither want nor need the added expense of costly arguments over the grounds for the divorce and the new law will enable them to focus instead on the arrangements for their children and finances”.
