Ruth advises insolvency practitioners, directors, creditors, debtors and other interested parties in all aspects of corporate and personal insolvency, both contentious and non-contentious.

Ruth acts for Insolvency Practitioners in relation to all aspects of insolvency including transactions at undervalue, preferences, misfeasance, wrongful/fraudulent trading, asset recovery and preservation, retention of title and property realisation. She regularly advises office-holders on the validity of their appointments and acts for both sellers and buyers in purchases of businesses and assets out of insolvency.

She also advises individuals and companies in financial difficulties on their options, and directors on their duties and responsibilities. She is experienced in defending claims by office-holders and advising directors in relation to the Company Directors Disqualification Act 1986. She has had particular success in assisting directors in obtaining permission to act whilst disqualified.

Ruth has an interest in cross-border insolvency and is a member of Geldards’ German Desk. She regularly acts for German banks and creditors, particularly in matters of enforcement and personal insolvency forum shopping (also known as bankruptcy tourism).
