• Restructuring: Planning for and implementing the departure of senior directors within a large manufacturing organisation, including limiting liabilities, leading and resolving negotiations, and identifying and managing commercial issues.

  • Collective Consultation: Advising upon significant variation to terms and conditions for the entire workforce of a large manufacturing organisation, including advising upon risks, consultation process and implementation to ensure terms were incorporated with minimum disruption to workforce and exposure for the business.

  • Redundancy: Advising a large security business on the closure of one of its sites and collective redundancy process and implications for a large number of staff. Assisting the client with the complex collective consultation requirements and supporting the client with all necessary documentation.

  • Settlement Agreements: Advising a Finance Director of a large engineering business on her exit from the business and successfully negotiating and agreeing terms of a settlement agreement to resolve all disputes between the parties and avoid litigation. This also included ensuring the individual was classed as a good leaver in respect of her shareholding in the business.

  • Exit Package: Successfully planning for and managing the exit of a Chief Operating Officer for a large technology based company with minimal exposure for the company and including the buy-back of shares and redemption of outstanding loan notes.

  • Employment Tribunal: Successful defence for a national pharmaceutical company to uphold the original Tribunal’s decision that the Claimant had been fairly dismissed and that there was no discrimination by the company towards him at any time.

  • Employment Tribunal: Successfully negotiating an out of court settlement for a significant UK car retailer. The former employee had brought claims for both unfair dismissal and disability discrimination.

  • Restructure: Advising an international retailer and wholesaler on the departure of a senior executive within the company following a planned restructure. Successfully negotiating terms of settlement and drafting settlement agreement to incorporate the terms with minimal exposure to the client.

  • Redundancy Process: Advising a significant manufacturing client in the food sector in relation to a large scale redundancy procedure involving over 100 employees, including advising upon the process to follow, collective consultation requirements and assisting with claims arising from employees following dismissal.

  • Redundancy Process: Advising a large and notable engineering company through a large scale redundancy process, including limiting liability, advising throughout the collective consultation process and resolving claims following termination.

  • Preliminary Investigator: Acting (as required by statutory instrument) in relation to disciplinary allegations against statutory and chief officers.

  • Holiday Pay: Advising on alterations to the client’s structures to ensure compliance following European Court decisions.

  • Terms & Conditions: Advising on restructuring and changing terms of conditions of employment, which included advising on threatened industrial action.

  • Discrimination: Advising on the defence of a claim on the ground of religion and belief.

  • Advising on the minimum wage implications of EAT decisions on payment whilst sleeping at service users’ premises.

  • Academy Conversions: We have played a primary role in the academy conversion process involving a large number of primary and secondary schools on behalf of clients such as the Lichfield Diocesan Board of Education. Our work has involved advising both the schools and MAT’s throughout the conversion process, including advising upon equal pay claims, restructuring senior leadership teams, varying terms of employment, and liaising with Trade Unions, staff and key stakeholders throughout consultation processes.

  • TUPE: Advising upon, co-ordinating and managing all TUPE related issues, including facilitating and attending consultation meetings with a number of Trade Unions in relation to the conversion of a cluster of 4 schools into a multi-academy trust. This was one of the first examples involving the transfer of staff of a mixture of both voluntary aided and voluntary controlled schools into a multi-academy trust.

  • Various local authorities: We continue to act for a large number of local authorities in relation to the defence of equal pay claims, involving advising on settlement terms and the implementation of new pay structures.
