£400,000 damages recovered by Geldards following negligent eye surgery

Our Medical Negligence Senior Associate, Rachel Kirby, has settled a case for £400,000 on behalf of a client who underwent a negligent right cornea replacement at Brighton Hospital in 2017.

Our medical expert concluded that a substandard method had been used to measure the client’s eye pressure. As a result, this caused our client irreversible optic nerve damage and a loss of vision. Due to his deteriorating vision, our client is no longer able to drive and is therefore unable to continue his work as a Design Engineer.

Liability was initially denied by the University Hospitals Sussex NHS Foundation Trust and further allegations were submitted. After obtaining medical advice, the Trust put forward a settlement offer of £35,000 which was promptly rejected.

A Joint Settlement Meeting took place in November 2021. Following intensive negotiations and lengthy discussions, an agreement was reached that the Trust would pay the Claimant damages of £400,000 plus costs.
