Procurement Act 2023: Implementation in practice and recent case law
Join our next webinar on implementation in practice and recent case law, where we will explore issues of interest relating to the Procurement Act 2023 together with Oliver Jackson from 11KBW.
On Friday 1st May 2026, HHJ Keyser KC dismissed applications by contracting authorities to lift an automatic suspension under the Procurement Act 2023 in Parkingeye Ltd v Velindre University NHS Trust [2026] EWHC 1019 (TCC). This is the first case addressing applications to lift under the Procurement Act 2023.
The Court held that the legal test was “substantively and not merely formally very different in both its method, and its effect from the former test as found in regulation 96(2) of the Public Contracts Regulations 2015″. In a marked difference from the previous regime, the Court also explained that “the public interest will generally tend in favour of keeping the suspension in place”.
Oliver Jackson acted for the successful claimant. During this webinar with Geldards, he will discuss: (i) How applications to lift the automatic suspension under s.102 of the Procurement Act 2023 differ from the equivalent applications under the Public Contracts Regulations 2015; (ii) The role of damages; and (iii) Lessons learned.
