A Section 106 agreement, often referred to as a planning obligation, is a legally binding agreement between a local planning authority and the owners of development entered under section 106 of the Town and Country Planning Act 1990.

Section 106 Agreements can be used to:

• secure affordable housing;
• fund or deliver local infrastructure, such as schools, roads and open spaces;
• manage the phasing of development and triggers for payments;
• control the use or occupation of a development to protect local amenity.

In this webinar, Charles Felgate and Tomos Phillips will provide an introduction to the legal principles and processes involved in drafting and negotiating planning obligations under Section 106 of the Town and Country Planning Act 1990 in Wales.
