Introduction to Section 106 Agreements
A Section 106 agreement, often referred to as a planning obligation, is a legally binding agreement between a local planning authority and the owners of development entered under section 106 of the Town and Country Planning Act 1990.
Section 106 Agreements can be used to:
- secure affordable housing;
- fund or deliver local infrastructure, such as schools, roads and open spaces;
- manage the phasing of development and triggers for payments;
- control the use or occupation of a development to protect local amenity.
